Fantasy Hockey Journal Fantasy Hockey Pool Rules and Terms of Use
The Game Fantasy Hockey Journal Fantasy Hockey Pool ("Contest") is an on-line game designed to test one's own prognostication skills when it comes to predicting the performance of various hockey players on various teams. From all eligible entries received, winners will be determined based on their ability to use their skill and knowledge of hockey teams, players and related rules to accumulate the most Pool Points in accordance with the Scoring System as described below and these Official Rules. The Contest will coincide with the NHL 2011-2012 regular season. Eligibility The Contest is open only to people who have reached the age of majority. The Contest is void in jurisdictions where prohibited by law or where licensing is required. Employees of Fantasy Hockey Journal, or any subsidiaries, affiliates, advertising, promotion or publicity agencies, or members of their immediate families, are not eligible to win. If you are ineligible for the contest, you may play the game and have your place noted in the standings; however you will not be eligible to win a prize. How to Enter To enter Fantasy Hockey Journal Fantasy Hockey Pool you must register by correctly completing and submitting the on-line Entry Form -- hereafter named "Entry Form". Online entries are accepted at any time before Oct 6, 2011 at 4:00pm PT. Upon registering you will enter a first and last name, email and password. Please make a note of this information. You will be required to enter your email address and password if you would like to make any changes prior to the entry deadline date. Entries submitted after the start of the NHL 2011-2012 regular season but before the deadline date will still receive points retroactive to the start of the 2011-2012 regular season. How to Play The objective of Fantasy Hockey Journal Fantasy Hockey Pool is to accumulate the most number of Pool Points based upon the contest Scoring System (see Scoring System below) and in accordance with these Official Rules. Each team you select will consist of 1 player from each of the boxes. *If a player is injured, he cannot be swapped out. Scoring System All Forwards: 1 Goal = 1 Pool Point. 1 Assist = 1 Pool Point. 1 Shootout Goal = 1 Pool Point. All Defense: 1 Goal = 1 Pool Point. 1 Assist = 1 Pool Point. 1 Shootout Goal = 1 Pool Point. All Goalies: 1 Win = 1 Pool Point. 1 Shutout = +2 Pool Points (3 total including a win). 1 Goal = 1 Pool Point. 1 Assist = 1 Pool Point. 1 Shootout Goal = 1 Pool Point. Standings and Updates Contest standings are updated daily on the web site. The web site will include player and entrant point totals. All statistics are updated daily, seven days a week. IMPORTANT: standings are UNOFFICIAL for one week following the conclusion of the 2011-2012 regular season. In the event there is a discrepancy please notify HockeyDraft.ca within the one week Unofficial Standings Period, otherwise the standings will become final and official. Winners and Prizes The entrant with the most Pool Points accumulated during the 2011-2012 regular season will win the grand prize. The following is the official breakdown of prizes:
Fantasy Hockey Journal Fantasy Hockey Pool is not a draft. Therefore, there is a possibility that two entrants may end up with the same player selections. In addition, two different rosters may add up to the same total points. In case of a tie the following rules will apply: Between the pool teams that are tied, the pool team that has the least shootout goals will prevail. If it is still tied, the pool team with the most goals will prevail. In the event that the tied winners have chosen the same players, prizes will be divided between the tied entrants. Terms and Conditions Fantasy Hockey Journal Fantasy Hockey Pool (the "Contest") is an on-line game, designed to test one's own prognostication skills when it comes to predicting the performance of various hockey players on various teams. From all eligible entries received, winners will be determined based on their ability to use their skill and knowledge of hockey teams, players and related rules to accumulate the most Pool Points in accordance with the Scoring System. Only one entry per person is permitted. Both the first and last name of the entrant must be entered for the entry to be valid. In addition, government issued identification must be provided by the winner(s) and the name on the identification must match the name on the entry form. All entry forms become the property of HockeyDraft.ca and Fantasy Hockey Journal. In any dispute, the decisions of Fantasy Hockey Journal will be final and binding on all parties. Fantasy Hockey Journal, HockeyDraft.ca, and the persons and companies affiliated with this contest, their employees, representatives or agents will not be responsible for human, computer or equipment error, or lost, late, or misdirected entry forms. The potential prize winner will be posted on-line on the Monday following the final game of the 2011-2012 regular season. All potential prize winners are unofficial for a one week period after the final game. In the event there is a discrepancy please notify HockeyDraft.ca via the contact address listed on HockeyDraft.ca within the one week period, otherwise the standings and prize winners will be declared final and official. All taxes and any expenses not indicated herein are the sole responsibility of the winners. Entrants must notify Fantasy Hockey Journal of any address change. Prizes are not transferable or redeemable in any other service and must be accepted as awarded. Acceptance of prize Prizes must be accepted as described in these Contest Rules and may not be transferred to another person, substituted for another prize, or exchanged in full or in part for cash, subject to the section below. Substitution of prize In the event it is impossible, difficult and/or more costly for the Contest Organizers to award a prize (or part of a prize) as described in these Contest Rules, the Contest Organizers reserve the right to award a prize (or part of a prize) of similar nature and equivalent value or, at their sole discretion, the value of the prize (or of the part of the prize) in cash. Liability limit – use of prize Each entrant and any potential or declared winner releases the Contest Organizers, their subsidiaries, respective divisions, their parent corporations, their advertising and promotional agencies, their shareholders, officers, directors, employees, agents and representatives (hereinafter: the “Beneficiaries”) from any and all liability for any and all damage, loss or liability suffered as a result of or arising from the entrant’s participation in the Contest or the acceptance or use of his/her prize. In order to be declared a winner and prior to obtaining his/her prize, any potential or declared winner agrees to sign a declaration to such effect in the Release Form. Warranty Any person selected for a prize acknowledges that the only warranty applicable to the prize is the standard manufacturer warranty. Fantasy Hockey Journal reserve the right to unilaterally disqualify entries. Fantasy Hockey Journal reserve the right to modify contest rules at any time. HockeyDraft.ca and Fantasy Hockey Journal reserve the right to cancel the contest at any time, without liability. Potential prize winners will be contacted within 30 days of the conclusion of Fantasy Hockey Journal Fantasy Hockey Pool. The potential prize winner must return via regular mail or e-mail an affidavit of eligibility and a liability/publicity release within 15 days following attempted notification. The winner of a prize must consent to the use of his/her name and picture for promotional purposes related to this contest. The winner will release HockeyDraft.ca, Fantasy Hockey Journal, and others involved, its advertisers, suppliers and other companies affiliated with this contest, from all liability for all damages or personal injuries in connection with the winner's use of the prize goods and services. By entering the contest you acknowledge agreement of the contest rules. Chances of winning are dependent upon the skill used in selecting your team and the total number of entries received. For the purpose of awarding the Prize it is the sole responsibility of the entrant to inform HockeyDraft.ca and Fantasy Hockey Journal within a week of the end of the 2011-2012 regular season of any discrepancy with his/her player roster. By entering the Contest, each entrant agrees to abide by these Contest Rules. In the event the potential or declared winner fails to comply with any one of the conditions set out above or any other conditions set out in these Contest Rules, the Contest Organizers reserve the right to disqualify such entrant from the Contest and if time allows, a new draw for the prize will be held in accordance with these Contest Rules, until an entrant is selected and declared a winner, without affecting the order in which other prizes are awarded. Entry Forms are subject to verification by the Contest Organizers. Any Entry Form which is incomplete, incomprehensible, inaudible, illegible, fraudulent, mutilated, altered, contains false information or is not received within the Contest Period, or any Entry Form which does not have the full requirements completed or otherwise does not confirm to these Contest Rules will automatically be rendered invalid and will not entitle such entrant to be eligible for a prize. By entering this Contest, an entrant consents to the collection, use and disclosure of his/her personal information by Fantasy Hockey Journal or HockeyDraft.ca for the purposes of alerting you of news, announcements and other related information. Liability limit – running of the contest The Beneficiaries are not liable for faulty computer components, software, or links; the loss or non-existence of communications capability; or faulty, incomplete, incomprehensible, or erased computer or network transmissions that make it difficult, or render a user unable, to enter the contest; problems with any website or website feature howsoever caused, the malfunction of, or damage caused to, any telephone or network or lines, computer equipment, data or software, online systems, servers or access providers; or the security or privacy of information transmitted via computer networks; or for breaches of privacy due to interference by third party computer “hackers” The Beneficiaries are not liable for any harm contestants may suffer directly or indirectly as a result of downloading any Web page or software or transmitting any information related to entry in the Contest. Further, the Beneficiaries assume no responsibility for entries lost, stolen, delayed, damaged or misdirected. Web site access The Beneficiaries do not guarantee access to or non-interruption of the Web site during the Contest Period or that it will be exempt from any errors. Impossibility to act – labour dispute The Beneficiaries shall not be responsible for any damages for a failure to operate the Contest in accordance with these Contest Rules in any case where their incapacity to act results from circumstances or a situation beyond their reasonable control or because of a strike, lock-out or any other labour dispute in their company or those of businesses which services are used for holding this Contest, war, riot, insurrection, earthquake, terrorism, civil commotion, fire, flood, accident, storm or any other act of nature. Liability limit– participation Any person who participates or tries to participate in this Contest releases the Beneficiaries from any and all liability for damages which he/she could suffer from participating or trying to participate in this Contest. Unenforceability If a section of these Contest Rules is declared or ruled by a Court of Law as illegal, unenforceable or void, that section will be deemed void but all other sections not affected will be enforced as allowed by Law. Jurisdiction This Contest is subject to all applicable federal, provincial and municipal laws. This site is created and controlled by HockeyDraft.ca, in the Province of British Columbia, Canada. As such, the laws of the Province of British Columbia, and the federal laws of Canada applicable therein, shall govern these disclaimers, terms and conditions, without giving effect to any principles of conflicts of law. HockeyDraft.ca reserves the right to make changes to its site and these disclaimers, terms and conditions at any time. The parties have required that this agreement and all documents related hereto be prepared in English.
